These Terms of Service ("Terms") are a legal agreement between you and TrailGauge ("TrailGauge", "we", "us") governing your use of the TrailGauge mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and these Terms. You may not copy, modify, reverse-engineer, redistribute, rent, or resell the App except as permitted by law.

2. The App is a tool, not a guarantee

Ride safely TrailGauge is a navigation and recording aid. It is not a substitute for your own judgment and attention. Always obey traffic laws, watch the road, and ride within your ability. Do not interact with your phone while riding in a way that distracts you. Maps, routes, distances, and arrival estimates may be incomplete or inaccurate, and GPS signal may be unavailable. You are solely responsible for your safety and for how you use the App.

3. Health and fitness data

Speed, distance, elevation, calories, and other fitness metrics shown by the App are estimates and may not be accurate. They are provided for general informational purposes only and are not medical advice. Consult a qualified professional before beginning or changing any exercise program.

The App offers a free tier and an optional Premium upgrade that unlocks features such as offline map downloads, route planning, navigation, advanced analytics, and additional themes. Premium is available as:

The annual subscription may include a free trial. Where a free trial is offered, it automatically converts to a paid subscription unless you cancel at least 24 hours before it ends.

5. Acceptable use

You agree not to use the App to violate any law, to interfere with or disrupt the App or its providers, or to attempt to gain unauthorized access to any system. You are responsible for any content (such as imported routes) you bring into the App.

6. Maps and third-party data

Map data is © OpenStreetMap contributors and is provided under the Open Database License (ODbL). The App also uses third-party services (including Apple, Google Firebase, Singular, and RevenueCat). Your use of those services may be subject to their respective terms.

7. Intellectual property

The App, including its design, code, graphics, and trademarks, is owned by TrailGauge and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or content except the limited license stated above.

You agree to indemnify and hold TrailGauge harmless from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms, to the extent permitted by law.

11. Apple-specific terms

You acknowledge that these Terms are between you and TrailGauge only, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

12. Termination

These Terms remain in effect while you use the App. We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time by deleting it.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which TrailGauge is established, without regard to its conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
